Wrong Way Crash Injures Two

Early this morning, a wrong way driver traveled six miles up I-55 and crashed into another vehicle on Lake Shore Drive – critically injuring both drivers. The Jeep slammed into the Toyota Corolla on the ramp from southbound Lake Shore Drive to the outbound Stevenson. The injuries appear to be non-life-threatening. Both drivers were being treated at Northwestern Memorial Hospital. Alcohol is suspected as a possible factor in the accident.

Britax Recalls 14,000 Infant Safety Seats

Britax Child Safety Inc. is recalling certain Chaperone restraint systems for infants because the harness adjusters may detach from the seat.  The affected seats were built between September 1, 2010 and April 30, 2011 – 14, 220 of which were sold in the United States. If the adjusters – which are used to tighten and loosen belts to keep the child in the seat – were to break, the child would not be properly restrained during a crash.  These types of defects have the potential to be serious and even fatal. Car Crash with Chicago Fire Department Engine Injures Nine

An 18-year-old has been charged with a DUI after crashing into a Chicago Fire Department engine on Tuesday night. The crash happened at South Halsted and 128th Place and sent nine people, including three children, to the hospital.  Christopher Caston was charged with failure to yield to an emergency vehicle, failure to stop at a stop sign, and driving with no proof of insurance. The children and two adults are hospitalized (four at Advocate Christ Medical Center and one at Stroger Hospital in Chicago) in critical condition. The four firefighters were treated at MetroSouth Medical Center in Blue Island and are in good condition.

Man Dies After Being Struck by Bus

A visually impaired man was killed after being hit by a Pace Bus in Oak Park, Illinois. He was initially taken to Loyola Medical Center with serious injuries to his legs, but died shortly after getting to the hospital. The accident is continuing to be investigated by the Oak Park Police Department.

Teen Pedestrian Struck by Semi-Truck

A high school senior is in serious condition after being hit by a semi-truck outside of Curie High School. The student was pinned under the truck after being struck. The teen suffered serious injuries and is currently in critical condition at Mt. Sinai hospital.

Pedestrian Dies After Being Hit by Car in Elgin

In Elgin, a woman died Sunday night after being hit by a car while she was crossing the street. This was not a hit-and-run and alcohol was not involved. Her name has been withheld until family is notified.

Woman Dies from Crash Injuries

Just one day after her wedding, a Buffalo Grove woman, Shruti Phadnis, was involved in a fatal car accident on Illinios Highway 21 in Lincolnshire. Her car collided head-on with a vehicle traveling the wrong way. A few days after the accident, Shruti died as a result of the injuries she sustained in the crash. Three other individuals were hospitalized, but have since been released.

Ban Cell Phones? NTSB Says Distracted Driving Must End

The National Transportation Safety Administration has recommended that all cell phone use – emails, texts, and calls – be banned.  The agency notes that thousands of American have died in crashes in Illinois and around the country from distracted driving.

Rules (Hopefully) Pull Dangerous Taxi Drivers Off Road Sooner

Recently, the City of Chicago announced proposed reforms of the cab driving rules.  “One of the most important proposed changes is that the City of Chicago will have real-time access to the Secretary of State’s moving violation database,” Grant said.  Right now, taxi drivers submit their own driving records and have to do it only once a year.  Grant continued, “the current system is easy to abuse.  It relies on cab drivers to be honest about their driving record.  It is simply not a practical system.”

Results Matter for 1,400,000 Reasons

On a foggy day in December, 2006, a truck driver pulled out into the intersection of a State Highway.  He knew he could not see but he pulled his rig – loaded with 80,000 pounds of corn – into the intersection anyway.  Sadly, another truck was coming over the bridge right into the intersection.  The second driver, Steven Smith, could not avoid crashing into the trailer of the truck that had pulled out in front of him.

Mr. Smith turned to Dixon Law Office for help.  The defense tried to argue that Mr. Smith could have swerved his truck over a median and into oncoming traffic.  G. Grant Dixon III, founder of the Dixon Law Office, set out to prove that his client was not at all at fault.  He and his team were able to locate an independent witness who saw the entire crash.  That witness said the driver of the semi should never have pulled into the intersection at all and that the Dixon Law Office client, Mr. Smith, acted properly.  The witness also described how seriously Mr. Smith was injured.

Indeed, the injuries were horrific.  At the time of the crash, Mr. Smith was thrown into the windshield.  He was covered in blood and his neck was shattered.  Witnesses described how he was barely conscious at the scene.  Doctors at the emergency room learned that the 33 year-old driver’s neck was shattered but the injuries were too complicated to be treated there.  The patient was forced to return home to El Paso, Texas, with a broken neck to get treatment there.

The neck injuries were so complicated, in fact, that most doctors would not even treat him.  Finally, one of the premier neurosurgeons in the world agreed to see him.  That doctor later performed surgery using a computer and was able to help treat the condition.  Even with that, Mr. Smith was left in terrible pain.

Grant then began to prepare the case for trial.  He traveled to Louisiana to meet with the surgeon.  Face-to-face, Grant was able to discuss his testimony in detail.  Grant also discussed the facts with many other witnesses, all to get ready for trial.

As the case progressed, the other side asked mediate the case.  Mediation is where the lawyers present their case to an independent lawyer who evaluates the case and makes recommendations about settlement.  After hours of mediation, the mediator recommended a settlement of $1,400,000.

Serious Injuries from Bus Crash, Serious Results

When a pedestrian is crossing the street, they assume they are safe.  “This woman was doing exactly what she was supposed to do.  She was crossing with the light and in the crosswalk.  The bus driver just blew it,” said G. Grant Dixon III of the Dixon Law Office.   The bus driver made a left turn into the crosswalk, striking the woman. Witnesses described how the woman went flying and laid unconscious on the ground.

Sadly, the woman was very seriously injured.   She was hospitalized for days, missed three months of work, endured more than two years of therapy, and left with permanent pain.  Her entire life became ruled by pain.

After retaining Dixon Law Office, the staff immediately began its work of showing how terrible the conduct of the driver was.  Investigation revealed the driver was fired after the incident and had a number of prior problems with her employer.

Truck Crashes – Trucks Must Follow the Same Rules of the Road

Some of the most horrific and tragic crashes involve large trucks and semis.  Many of these trucks weigh more than 80,000 and cause tremendous damage when involved in a crash.

Well-established regulations require trucks to follow the same rules of the road as other drivers.  Section 392.2 of chapter 49 of the Code of Federal Regulations is part of the Federal regulations that govern trucks.  It says:

Every commercial motor vehicle must be operated in accordance with the laws, ordinances, and regulations of the jurisdiction in which it is being operated. However, if a regulation of the Federal Motor Carrier Safety Administration imposes a higher standard of care than that law, ordinance or regulation, the Federal Motor Carrier Safety Administration regulation must be complied with.

That means that truckers have to follow the driving rules of the State in which they are driver OR the Federal Motor Carrier Safety Administration rules, whichever is HIGHER.  According to G. Powerless

This past Monday, a strong thunderstorm rolled through the Chicago area leaving a trail of devastation in its wake.  Hundreds-of-thousands of people were left without electricity, telephone, or cable television.  We at Dixon Law Office were not spared from the damage.  Electricity and our internet connection were severed for two days.  Because of advanced planning, we had a back-up generator that kept the phones and computers running.  Still, the storm reminded us of how much of a disruption to our normal lives a storm like this can cause.

During that time, we were reminded that what brings clients to our door is a storm of a different type.  For nearly all our clients, they did nothing to cause the trauma in their life.  They were victims of another person’s poor choices.  Our clients walked out their doors that day thinking it was just another day.  For most of them, that day ended with pain and trauma.  Sadly for many others, they never came home again.

Pedestrian Safety

Taking a stroll along the sidewalk is a pleasure most of us enjoy.  However, when a driver is not paying attention, it can be dangerous.  Dixon Law Office founder G. Dangerous Vehilces – Small Electric Cars

They are popular in retirement communities.  You may have seen them cruising around the treets of your neighborhood.  The look like electric golf carts on steroids.  The ave headlights, seatbelts, and seats but not much else.  They are cute and fun looking with top speeds up to 30 mph.  And they are very dangerous.  “Most people think they are safe simply because they are on the road,” said G. Car Seat Safety – Children Under 1 Year Old

Before you take your new baby on the road, make sure you have a safe car seat.  According to the National Highway Transportation Safety
Administration
, children less than 12 months old should be in a rear-facing car seat.  Seats that are removable or have multiple positions  may

Consumer Safety Website Launches

The US Consumer Products Safety Commission has launched a new website to help consumers. The website is called www.SaferProducts.gov.  With the new website, “consumers will have open access to product safety information that they have never seen before and the information will empower them to make safer choices,” said Chairman Inez Tenenbaum, chairperson of the CPSC. On the Report tab, consumers report any problems they have with a product they already own. On the Search tab, consumers can check products to see if there are any reported problems or recalls.  “This website makes more of the amazing data the CPSC has available to the public and hopefully will encourage manufacturers to report unsafe products more quickly,” Dixon Law Office founder Grant Dixon said.

Dropped Call

A woman dropped her cell phone as she was recently driving through Park Ridge, Illinois. She reached to pick it up. As she did so, she swerved and struck a parked car. That car hit a second car, the driver drove into a third. The woman reportedly continued driving until she pulled into the Village Green Shopping Center, 678 N. Northwest Hwy. According to the accident report, the woman said she did not immediately stop after the accident “because she was shaken and scared from what just occurred and did not know where her phone was.” Distracted driving is a real problem today. This accident could have been avoided if the driver had simply pulled over after dropping her phone. Seems like an expensive dropped call.
