Britax Recalls 14,000 Infant Safety Seats

Britax Child Safety Inc. is recalling certain Chaperone restraint systems for infants because the harness adjusters may detach from the seat.  The affected seats were built between September 1, 2010 and April 30, 2011 – 14, 220 of which were sold in the United States. If the adjusters – which are used to tighten and loosen belts to keep the child in the seat – were to break, the child would not be properly restrained during a crash.  These types of defects have the potential to be serious and even fatal. Johnson & Johnson Recalls Aveeno Baby Calming Comfort Lotion

Johnson & Johnson Consumer Companies, Inc. is recalling one lot of Aveeno Baby Calming Comfort Lotion as sold in Alabama, Arkansas, Florida, Georgia, Kansas, Louisiana, Mississippi, Tennessee and Texas. These products, based upon a small testing sample conducted by the U.S. Food and Drug Administration, show that they exceed the specifications for common bacteria. Triple Eight Distribution Recalls Bicycle Helmets

Triple Eight Distribution, Inc. has recalled  children and youth bicycle helmets because users could suffer head injuries after a fall.  The helmets, sold from August 2006 through November 2011, do not comply with the U.S. Consumer Product Safety Commission for impact resistance.   Dixon Law Office represents bicyclists who suffer serious injuries in bicycle crashes.  “Consumers rely on bicycle helmets to protect them from

IKEA High Chairs Recalled

IKEA has voluntarily recalled  ANTILOP high chairs because the buckle restraint can open without warning. These high chairs were sold from August 2006 through January 2010. If you are using one of these high chairs, immediately stop use and contact IKEA  for further instructions.

Crashes Can Be Caused By Defective Bicycle Pedals

Reebok To Pay $25,000,000

You may have seen those shoes that claim to provide extra tone in your legs and buttocks if you will simply buy the shoes and walk in them.  The manufacturer of one of those shoes, Reebok International, Inc., has agreed to pay a whopping $25,000,000 to settle a charge brought by the U.S. Federal Trade Commission.  The FTC charged that Reebok falsely advertised the shoes with such claims. “The FTC wants national advertisers to understand that they must exercise some responsibility and ensure that their claims for fitness gear are supported by sound science,” said David Vladeck, Director of the FTC’s Bureau of Consumer Protection.

To settle the charges, Reebok agreed to a Federal Court order to stop making claims that toning shoes and other toning apparel are effective in strengthening muscles, or that using the footwear will result in a specific percentage or amount of muscle toning or strengthening, unless the claims are true and backed by scientific evidence.  “It is pretty clear that the FTC is cracking down on false advertising.  This is a good thing because consumers rely on manufacturers to be truthful.  This shows that they often are not,” said Dixon Law Office founder, G. Specialized Bicycle Recalls Carbon Fiber Forks

High-end bicycles often have forks (the part that holds the front wheel) made of carbon fiber.  Carbon fiber is light but stiff so it is a popular choice.  Specialized Bicycle has recalled more than 14,000 bicycles with a carbon fiber fork.  The brake component, housed inside the fork, can separate from the fork, fall into the wheel and cause the rider to fall.  The following models of 2011 Specialized bikes are involved in the recall: Sirrus Expert, Sirrus Comp, Sirrus Elite, Vita Expert, Vita Comp, Vita Elite, Vita Elite Step Thru, Tricross Sport, Tricross, and Tricross Comp. All bicycles have the brand name “Specialized” on the lower front frame tube. The model name is on the top tube.

Mountain Bike Dangers

More than 27,000,000 children aged 5 to 14 ride bicycles, the Centers for Disease Control and Prevention estimated in a 1994 study.  Off-road bicycles, known as mountain bikes, account for 62 percent of new bicycle sales in the United States.  But they are not just for off-road use. Mountain bikes are as frequently seen on city streets as well.

Soccer Goal Safety Law Prevents Tragic Injuries, Death

Eight years ago, a moveable soccer goal tipped over onto the head of Zach Tran, killing him.  A new Illinois law will prevent serious injuries and deaths like Zach’s.  The new law is called the Moveable Soccer Goal Safety Act and was recently signed into law.

The new law requires current owners of moveable soccer goals to create a soccer goal safety and education policy that outlines how the organization will specifically address the safety issues associated with movable soccer goals.  It also requires all soccer goals sold in the future be tip resistant.

Dangers of Acetaminophen to Kids

The dangers of acetaminophen in children has been known for years but parents often don’t know there is any risk.  They assume that because the medicine is available over-the-counter, it is safe.  Often labels are so confusing it is difficult to determine the right dose and even when they do, the labels frequently don’t explain the risk.  Overdosing of acetaminophen can cause simple problems like an upset stomach.  In serious cases, overdosing can cause nausea, vomiting, kidney failure, even death.

Target Recalls Step Stools Due to Fall Hazard

The US Consumer Product Safety Commission and Target have announced a recall of over 200,000 wooden step stools.  The stools are made of wooden and have two steps with storage under one of the steps.  The recalled stools are called “Circo” and “The Do Your Room.”  The stools have been reported to break and collapse when people stand on it.

Target has received 26 reports of the stools breaking or collapsing. Fourteen of the victims were children, seven were adults, and five incidents were reported where the user’s age was unknown. Two adults fractured their wrists, and of those victims, one also fractured her hip and pelvis. Additionally, six children and one adult suffered scrapes and bruising.

This past Monday, a strong thunderstorm rolled through the Chicago area leaving a trail of devastation in its wake.  Hundreds-of-thousands of people were left without electricity, telephone, or cable television.  We at Dixon Law Office were not spared from the damage.  Electricity and our internet connection were severed for two days.  Because of advanced planning, we had a back-up generator that kept the phones and computers running.  Still, the storm reminded us of how much of a disruption to our normal lives a storm like this can cause.

During that time, we were reminded that what brings clients to our door is a storm of a different type.  For nearly all our clients, they did nothing to cause the trauma in their life.  They were victims of another person’s poor choices.  Our clients walked out their doors that day thinking it was just another day.  For most of them, that day ended with pain and trauma.  Sadly for many others, they never came home again.

Car Seat Safety – Children Under 1 Year Old

Before you take your new baby on the road, make sure you have a safe car seat.  According to the National Highway Transportation Safety
, children less than 12 months old should be in a rear-facing car seat.  Seats that are removable or have multiple positions  may

Pool Safety – Drain Covers Recalled

Summer is pool season.  Whether you swim in a neighborhood pool or one in your backyard, you assume the pool has been designed and maintained properly.  Sadly, that is frequently not the case.  The Consumer Products Safety Commission has announced a recall of more than 1,000,000 pool drains and covers.  The recalled drain covers were incorrectly rated to handle the flow of water through the cover, which could pose a possible entrapment hazard to swimmers and bathers.  “The flow through these covers is so strong, just being next to them can suck a swimmer in and cause them to be trapped.  Once trapped, the swimmer can drown and die,” Dixon Law Office founder G. Consumer Safety Website Launches

The US Consumer Products Safety Commission has launched a new website to help consumers. The website is called www.SaferProducts.gov.  With the new website, “consumers will have open access to product safety information that they have never seen before and the information will empower them to make safer choices,” said Chairman Inez Tenenbaum, chairperson of the CPSC. On the Report tab, consumers report any problems they have with a product they already own. On the Search tab, consumers can check products to see if there are any reported problems or recalls.  “This website makes more of the amazing data the CPSC has available to the public and hopefully will encourage manufacturers to report unsafe products more quickly,” Dixon Law Office founder Grant Dixon said.

REI Recalls Bikes

Outdoor equipment seller REI has recalled certain bicycles sold through its stores. Novara Fusion Bicycles were sold at REI in 2009 and 2010. The affected models were called “Step Through” and “Fusion”. The steerer tube – the part of the bike that attaches the fork and wheel to the handlebars – can unexpectedly separate causing the bike to collapse and injury the rider. Owners of these bikes should stop using them immediately and return them to REI where a replacement fork will be installed.

Felt Bicycle Recall

Felt Bicycles of Irvine, California recalled brand new 2011 Felt racing bicycles because the front forks are defective. About 1,550 Felt bikes are affected by the recall. The affected models are Felt F3, F4, F5 and F75 bicycles. All have carbon fiber frames AND carbon fiber forks. The forks are manufactured by ADK Technology Limited of Guang Dong, China. These are high end bicycles, usually sold in specialty stores across the US. Prices for the bikes range from $1,400 to $5,000 per bicycle. Bowled Over, Chicken Wings Recalled on Eve of Bowl Bonanza

It is just a few short days before the biggest day in college football and a major manufacturer of chicken wings is issuing a recall of more than 180,000 pounds of the football snack.  CNN is reporting that Pilgrim’s Pride is recalling breaded chicken wings it made between January 1, 2010 and October 6, 2010.  The packages were sold to distributors which will make tracking the individual wings down even harder.   Manufactured in Boaz, Alabama, the wings have egg as an ingredient even though it is not listed on the packaging.  If you or a loved one became sick after eating chicken wings or any other prepared food product, call us at Dixon Law Office.  We have experience in handling  food product cases and may be able to help you.

Snowblowers Recalled by Honda

American Honda has recalled more than 18,000 snow blowers because of fuel tank leaks, causing the potential for fires. The U.S. Consumer Products Safety Commission has received 90 reports of seeping or dripping gas from these snow blowers. According to a report by the CPSC, the fuel tank joint and o-ring located on the underside of the fuel tank can seep or drip fuel over time, posing a fire hazard. The snow blowers are red and black. The frame serial number is located on the rear of the machine just below the engine and the model number is located on the side of the front scoop. The effected model/frame serial numbers are:
HS724 / SZBE-1037913 through 1046577
HS928 / SZAS-1151080 through 1169012
HS1132 / SZBF-1018734 through 1025998

Jury Duty

As a very young lawyer, I was on trial before a very seasoned trial judge.  The judge was late in his career and nearing retirement.  He ran his courtroom with military precision and took no guff from anyone. You could tell, however, that he loved his job.

After some preliminary lawyer stuff, the jury was marched into the courtroom for jury selection.  The sheriff ordered us all to stand, out of respect, for the potential jurors.  The grey-haired judge then gave a little speech.  He said that our Country is unique from every other country in the world because it allows ordinary citizens to decide cases.  He said citizen juries were so important to our Founding Fathers, they put it in the Constitution so that the right of having citizens listen to cases would not be taken away.  That system has served this Country ever since.

The judge then said something I had never considered.  He said our Country asks us for our service in only two situations: war and jury duty.  Both require you to take an oath.  Both require your time.  Both require work.  And, both can involve life and death.  He asked that jury to take the work of jury service as seriously as we do service in times of war.

Recently, I was called for jury duty.  Like most people, I did not like the idea of having to spend a day at jury duty.  I did not have time for it.  I had other things to do, more important things to do.  Besides, who would put a trial lawyer on their jury?

Dutifully, I arrived at the courthouse on the given day at the time.  I walked the long hallways to the jury room.  When I arrived, I found hundreds of people.  Some were old, some young, some moms, some dads, some single people.  People from about every walk of life and in every color and shape.  It was a wide cross-section of Chicagoland.

We began the day by watching a short video about our jury service.  It explained the process of a jury trial in civil and criminal cases.  It explained who the parties were and their roles in the courtroom.  The video explained who was in charge and who could say what.  Other than being somewhat old, the video explained the process well.

As I listened to that video, I was reminded of my work.  As a trial lawyer, I have the privilege of spending a fair amount of time in front of juries.  I am constantly amazed at how 12 people work so hard.  They always pay attention.  They always look at the evidence very carefully.  They always take their job very seriously. In nearly every case, they arrive at the right decision.  All that work for about $17 a day.

The words of that old judge ring in my ear nearly every time I stand front of a new jury for the first time.  I feel honored that these people have taken their duty to their Country seriously.  I feel honored to be a part of a process that allows ordinary people to do these extraordinary things.  I enjoy helping my clients navigate through the process.  I love it when those juries give my clients the justice they deserve, the justice that was delayed for years.

Back in the jury room, we were getting packed up for lunch when jury panel 3 was called.  That was me.  Along with about 30 other people, we walked down to the courtroom.  I sat in the seats and listened as the judge’s clerk called out names for people to be questioned.  I was not picked to serve on the jury and, I must admit, I was a little disappointed.  I wanted to hear the evidence and make a decision with 11 other people.  Still, I know that just by being there, I served my Country in a small way.  Along with hundreds of others that day, I did my duty.

Boy Saves His Sister’s Life and Becomes a Superhero

On November 27, 2010, 9 year-old James ” JT”  Stone opened the child-proof lock on his parent’s bathroom to let his little sister Lily go into the bathroom.  Unbeknownst to JT, Lily decided she wanted to blow out the candle on the counter.  She climbed up the cabinet and onto the counter.  As she sat there, she tried to blow out the little flame.  Instantly, her hair, face, and arms caught fire.  JT heard his sister’s screams first and got to Lilly just before their mother did.  Thinking quickly, he grabbed a wet towel that had been left on the floor by an older cousin.  He wrapped his sister in the towel, dowsing the flames.

JT’s courage saved his sister’s life. “This young man did something most kids twice his age wouldn’t have the forethought, or capability, or understanding of performing,” said St. Louis Firefighter Shawn Bittle.   The group presented JT with a Hero Award for what he did.  He got a plaque, and a special tour of a firetruck.

“When you look at the superheroes, that’s their job to save lives,” said JT’s father, “and nobody will ever know how much of a hero he is to me. If it wasn’t for him I may not have my baby.”  “I’m thankful that I knew what to do to save her,” he said.

Ties that Kill

For more than 20 years, manufacturers have known that the pull cords on window shades and blinds kill children.  The Consumer Product Safety Commission received reports of 130 strangulations involving window blind cords in just the 9 years from 1991 through 2000.  Nearly all of those involved strangulations to infants getting tangled on the outer pull cords.

Ten years later, children are still dying and manufactures seem to be doing nothing about it.  This week, big box hardware store chain Lowes to recall about 6,000,000 Roman shades and 5,000,000 they sold in the last 10 years.  The reason: pull cords are still killing children.  If you have purchased any shades or blinds from Lowes since 1999, you should contact the Window Covering Safety Council for a free repair kit at (800) 506-4636.

As the saying goes, those who don’t learn from history are doomed to repeat it.  Apparently, the manufacturers of shades and blinds don’t know their history.  More likely, they just don’t care.  If you have ANY blinds with pull cords on them, cut the pull cords.  Call he Window Covering Safety Council or find them on the web at www.windowcoverings.org.  It might save a parent from the worst of all traumas, losing a child.
