Reebok To Pay $25,000,000

You may have seen those shoes that claim to provide extra tone in your legs and buttocks if you will simply buy the shoes and walk in them.  The manufacturer of one of those shoes, Reebok International, Inc., has agreed to pay a whopping $25,000,000 to settle a charge brought by the U.S. Federal Trade Commission.  The FTC charged that Reebok falsely advertised the shoes with such claims. “The FTC wants national advertisers to understand that they must exercise some responsibility and ensure that their claims for fitness gear are supported by sound science,” said David Vladeck, Director of the FTC’s Bureau of Consumer Protection.

To settle the charges, Reebok agreed to a Federal Court order to stop making claims that toning shoes and other toning apparel are effective in strengthening muscles, or that using the footwear will result in a specific percentage or amount of muscle toning or strengthening, unless the claims are true and backed by scientific evidence.  “It is pretty clear that the FTC is cracking down on false advertising.  This is a good thing because consumers rely on manufacturers to be truthful.  This shows that they often are not,” said Dixon Law Office founder, G. Dixon Law Office Wins Appellate Victory

She slipped and fell on invisible ice in a parking lot while leaving work.  She suffered very serious injuries from the fall.  From that day on, her life has changed.  To get compensation for her serious injuries, she hired Dixon Law Office.  “We knew she was right.  We also knew that proving it would be very hard,” said Dixon Law Office founder, G. Grant Dixon III.  Grant began investigating the case.  “Slip and fall cases are difficult, many lawyers will not take them.”  Grant was not dissuaded.  Grant began his representation by taking the unusual step of taking statements from the witnesses before filing suit.  “We wanted to be sure the evidence supported the case,” he said.

The suit filed named the landlord and snowplow company among others as defendants.  “Our investigation showed that the parking lot consistently had ice in it.  Witnesses told us that it was happening because the snowplow contractor was plowing snow into the corner of the building, it was melting and then freezing when it got colder.”  As the case continued, they learned the landlord was repeatedly told of the problem but never fixed it.

Predictably, defendants filed motions to end the case prematurely.  They all claimed that the case was improper.  Though Grant fought all the motions, the court granted the motions.  They had lost.

Grant was not satisfied.  “I recommended we file an appeal because I felt the judge had not properly considered the evidence,” he said.  “Fortunately, my client agreed.”  Few lawyers do trial work.  Even fewer do appeals.  It is truly rare to have a lawyer like Grant who does both.  Grant personally wrote the appellate briefs and argued before the Illinois Appellate Court.

The Appellate Court issued their opinion on September 30, only 10 days after hearing the case.  Grant noted that, “having a result that quickly is unusual.”  The opinion was solidly in favor of his client.  It reverses what the lower court judge did and sends the case back to the trial court.  “I am so happy for my client.  She is seriously injured and just wants the chance to have a jury hear her case,” Grant said.  He concluded, “I am also very proud of the work my office did in this case.”

Specialized Bicycle Recalls Carbon Fiber Forks

High-end bicycles often have forks (the part that holds the front wheel) made of carbon fiber.  Carbon fiber is light but stiff so it is a popular choice.  Specialized Bicycle has recalled more than 14,000 bicycles with a carbon fiber fork.  The brake component, housed inside the fork, can separate from the fork, fall into the wheel and cause the rider to fall.  The following models of 2011 Specialized bikes are involved in the recall: Sirrus Expert, Sirrus Comp, Sirrus Elite, Vita Expert, Vita Comp, Vita Elite, Vita Elite Step Thru, Tricross Sport, Tricross, and Tricross Comp. All bicycles have the brand name “Specialized” on the lower front frame tube. The model name is on the top tube.

The Right Hook

Race for ACES

Dixon Law Office is one of the title sponsors for the First Annual Le Tour de Burbs Rally to raise money for ACES. When teens need counseling and support, there is often a gap in available, affordable services even when insurance covers the visits.  ACES—Adolescent Counseling, Education and Support—is a non-profit organization that helps fill that gap.  The organization’s objective is to provide resources that may prevent adolescents from making decisions that could derail their futures when they are most vulnerable. They serve adolescents in Cook County’s Lyons and south Proviso townships.

The RACE for ACES will be held the afternoon of September 18, 2011 and is open to everyone.  Families, teams and individual cyclists are welcome but you don’t even have to ride to participate. There will be games, food and fun for everyone.  There will be bike decorating for kids, warm up exercises and a free bike safety check for riders.  As part of the event, the La Grange Theater is showing the classic movie, “Breaking Away” at 7:00 p.m.  There will be a great raffle with major prizes including a new bike from the Wheel Thing. Dangerous Riders

Television and film have glamorized the dangerous riding by bicycle messengers.  “Bicycle messengers who ride their bikes in a reckless and dangerous way make all people who ride bicycles look like they are dangerous,” said G. Falls from Windows Injure 5,000+ Kids Every Year

The American Academy of Pediatrics recently released a study that shows more than 5,100 kids visit emergency rooms each year, suffering injuries after falling from windows.   From 1990 through 2008, a staggering 98,415 children were treated in emergency rooms for injuries from window falls.  Most injured were young children, often falling through closed screens.  “Manufacturers have known for decades that window screens are not strong enough to hold back an inquisitive toddler,” said G. Fewer Medical Malpractice Claims, Payments Even Lower

A recent article published by the New England Journal of Medicine revealed that only 1.6% of doctors had claims against them in a year that resulted in payment.  “This article documents what we have been saying for years.  The facts show that doctors rarely get sued and their insurance companies almost never have to make a payment,” said G. Bicycles Riding on Roads – Is Right Right?

As young children, we are taught to ride our bikes on the right side of the road.  Generally that is the right answer but not always.  “Most States have laws that allow bicycles to ride in other places at certain times,” said G. Grant Dixon III, founder of Dixon Law Office and an avid cyclist.  For example, the Illinois Motor Vehicle Code requires bikes to ride on the right side of the road only when moving slower than the normal speed of traffic.  625 Ill.Comp.Stat. § 5/11-1505.  If the bicyclist is passing someone, preparing to make a left turn, or avoid something in the road, the bike can operate anywhere in the lane.  Grant concluded, “Motorists often ignore cyclists and that usually ends badly for the cyclists.”

Jury Duty Scam

What separates the American system of justice from nearly every other is that regular citizens hear cases and decide the result.  Nearly all of us have been called for jury duty at one time or another.  Some are reluctant, some are excited.  But appearing is a demonstration of respect for our system of justice that has worked for over 200 years.

Sadly, some people are trying to take advantage of the sense of duty and responsibility held by many Americans.  The Federal Bureau of Investigation has reported on a scam in which people are tricked into providing their social security number.  The scammer calls, saying you missed jury service.  They ask for your social security number for “confirmation.”  With that, they have all the information they need.  To read more about the scam, see the FBI’s story here.

Mountain Bike Dangers

More than 27,000,000 children aged 5 to 14 ride bicycles, the Centers for Disease Control and Prevention estimated in a 1994 study.  Off-road bicycles, known as mountain bikes, account for 62 percent of new bicycle sales in the United States.  But they are not just for off-road use. Mountain bikes are as frequently seen on city streets as well.

A study in American Family Physician reported on how often people were injured when riding a bicycle.  Head injuries accounted for only between 22 and 47% of all injuries.  Collisions with cars and trucks accounted for the over 60% of the catastrophic and serious injuries.  Injuries involving mountain biking are most common in men between 20 and 39 and are often caused by the rider striking an object or losing control on a descent.  For more about mountain biking injuries, or if  you are interested in the full text of the article, you can see it here.

Soccer Goal Safety Law Prevents Tragic Injuries, Death

The new law requires current owners of moveable soccer goals to create a soccer goal safety and education policy that outlines how the organization will specifically address the safety issues associated with movable soccer goals.  It also requires all soccer goals sold in the future be tip resistant.

Dangers of Acetaminophen to Kids

The dangers of acetaminophen in children has been known for years but parents often don’t know there is any risk.  They assume that because the medicine is available over-the-counter, it is safe.  Often labels are so confusing it is difficult to determine the right dose and even when they do, the labels frequently don’t explain the risk.  Overdosing of acetaminophen can cause simple problems like an upset stomach.  In serious cases, overdosing can cause nausea, vomiting, kidney failure, even death.

When a Dog Attacks

At Dixon Law Office, we recently met with the family of a young girl who was at the home of a friend.  She was just sitting on the couch.  Suddenly, the dog of the family she was visiting, got lose.  The dog then attacked the young girl.  The vicious attack left her permanently scarred physically.  She will likely bear emotional scars for the rest of her life as well.

Target Recalls Step Stools Due to Fall Hazard

The US Consumer Product Safety Commission and Target have announced a recall of over 200,000 wooden step stools.  The stools are made of wooden and have two steps with storage under one of the steps.  The recalled stools are called “Circo” and “The Do Your Room.”  The stools have been reported to break and collapse when people stand on it.

Target has received 26 reports of the stools breaking or collapsing. Fourteen of the victims were children, seven were adults, and five incidents were reported where the user’s age was unknown. Two adults fractured their wrists, and of those victims, one also fractured her hip and pelvis. Additionally, six children and one adult suffered scrapes and bruising.

Death by Medical Malpractice, Pulmonary Embolism – Video

Chet had been working out at the local YMCA when he passed out.  Staffed revived him and called his wife.  She picked him up and insisted they drive to St. Alexius Hospital Emergency Room to get Chet checked out.  The emergency room doctor suspected Chet had a pulmonary embolism.  “A pulmonary embolism is a blood clot that usually starts in the leg and moves into the lungs.  It can be very serious if left untreated,” G. Grant Dixon III said, the Dixon Law Office lawyer for the family.  The doctor ordered a series of tests to confirm Chet had a pulmonary embolism.

Sadly, the staff at St. Alexius did not get the tests done a quickly as they should have.  “It was the opinion of our experts that they simply forgot about Chet,” Grant said.  Still in the ER five hours later, Chet’s body started shaking violently, he was having a seizure.  “He had a pulmonary embolism.  Because of that, his lungs could not pump air.  That meant Chet was suffocating from the inside-out,” Grant said.  Though he had been there 5 hours, the doctors still had not treated Chet for a pulmonary embolism before he started seizing.  He died in the ER with his wife by his side.

“We took the case on to show that the staff at the hospital did something wrong,” Grant said.  Dixon Law Office staff pursued the case for more than 5 years, through trial.  “After the trial we were able to secure a large settlement on behalf of the family,” Grant said.

Results Matter for 1,400,000 Reasons

On a foggy day in December, 2006, a truck driver pulled out into the intersection of a State Highway.  He knew he could not see but he pulled his rig – loaded with 80,000 pounds of corn – into the intersection anyway.  Sadly, another truck was coming over the bridge right into the intersection.  The second driver, Steven Smith, could not avoid crashing into the trailer of the truck that had pulled out in front of him.

Mr. Smith turned to Dixon Law Office for help.  The defense tried to argue that Mr. Smith could have swerved his truck over a median and into oncoming traffic.  G. Grant Dixon III, founder of the Dixon Law Office, set out to prove that his client was not at all at fault.  He and his team were able to locate an independent witness who saw the entire crash.  That witness said the driver of the semi should never have pulled into the intersection at all and that the Dixon Law Office client, Mr. Smith, acted properly.  The witness also described how seriously Mr. Smith was injured.

Indeed, the injuries were horrific.  At the time of the crash, Mr. Smith was thrown into the windshield.  He was covered in blood and his neck was shattered.  Witnesses described how he was barely conscious at the scene.  Doctors at the emergency room learned that the 33 year-old driver’s neck was shattered but the injuries were too complicated to be treated there.  The patient was forced to return home to El Paso, Texas, with a broken neck to get treatment there.

The neck injuries were so complicated, in fact, that most doctors would not even treat him.  Finally, one of the premier neurosurgeons in the world agreed to see him.  That doctor later performed surgery using a computer and was able to help treat the condition.  Even with that, Mr. Smith was left in terrible pain.

Grant then began to prepare the case for trial.  He traveled to Louisiana to meet with the surgeon.  Face-to-face, Grant was able to discuss his testimony in detail.  Grant also discussed the facts with many other witnesses, all to get ready for trial.

As the case progressed, the other side asked mediate the case.  Mediation is where the lawyers present their case to an independent lawyer who evaluates the case and makes recommendations about settlement.  After hours of mediation, the mediator recommended a settlement of $1,400,000.

Serious Injuries from Bus Crash, Serious Results

When a pedestrian is crossing the street, they assume they are safe.  “This woman was doing exactly what she was supposed to do.  She was crossing with the light and in the crosswalk.  The bus driver just blew it,” said G. Grant Dixon III of the Dixon Law Office.   The bus driver made a left turn into the crosswalk, striking the woman. Witnesses described how the woman went flying and laid unconscious on the ground.

Sadly, the woman was very seriously injured.   She was hospitalized for days, missed three months of work, endured more than two years of therapy, and left with permanent pain.  Her entire life became ruled by pain.

Truck Crashes – Trucks Must Follow the Same Rules of the Road

Some of the most horrific and tragic crashes involve large trucks and semis.  Many of these trucks weigh more than 80,000 and cause tremendous damage when involved in a crash.

Well-established regulations require trucks to follow the same rules of the road as other drivers.  Section 392.2 of chapter 49 of the Code of Federal Regulations is part of the Federal regulations that govern trucks.  It says:

Every commercial motor vehicle must be operated in accordance with the laws, ordinances, and regulations of the jurisdiction in which it is being operated. However, if a regulation of the Federal Motor Carrier Safety Administration imposes a higher standard of care than that law, ordinance or regulation, the Federal Motor Carrier Safety Administration regulation must be complied with.

That means that truckers have to follow the driving rules of the State in which they are driver OR the Federal Motor Carrier Safety Administration rules, whichever is HIGHER.  According to G. Heatstroke, A Danger for Athletes

At a time when much of the country suffers from extreme heat, many kids are well into their pre-season training for Fall sports.  “The heat presents a very real danger for everyone but particularly children and student-athletes,” said G. Grant Dixon III, founder of Dixon Law Office.  According to Mayo Clinic, heatstroke is a life-threatening condition that occurs when your body temperature reaches 104 F.  Working out in high temperatures can cause heat stroke.  If it is not treated, heatstroke will cause brain damage, organ failure and eventually death the Mayo Clinic article says.

Sadly, athletes have died from heatstroke during and after football practices, basketball practices, and soccer.  Even professional athletes have died from the effects of extreme heat.  More than 3,400 people died of heat-related causes from 1999 through 2003, according to the Centers for Disease Control.

“In sports, the coaches have a responsibility to know the warning signs of heatstroke.  They also need to take precautions to be sure their athletes are protected,” Grant said.  The signs of heatstroke include confusion, dizziness, fainting, headache, heavy perspiration, nausea; pale and moist or hot, dry skin, weak pulse, and weakness.  Grant continued, “unfortunately, many coaches don’t know – or worse ignore – the warning signs. That’s when people can die.  It can be very serious.”

To protect their athletes, coaches should make sure their athletes take regular breaks during practice and games. Kids need to drink 8 ounces of fluid—preferably water—every 20 minutes, and more after playing.  When students get tired, they need rest.  When it is hot, coaches should supply misting fans to cool off the athletes.  “Most important if for the coaches to be aware of the heat and protect their athletes,” Grant concluded.
